《天津市人民政府规章立法后评估办法》已于202559日经市人民政府第76次常务会议通过,现予公布,自202571日起施行。

The Rules of the Measures on the Post-legislation Evaluation of the Governmental Rules of Tianjin Municipal People’s Government, having been adopted at the 76th?Executive Meeting of the Municipal People’s Government on May 9, 2025, is hereby promulgated and shall enter into force on July 1, 2025.

Measures on the Post-legislation Evaluation of the Governmental Rules of Tianjin Municipal People’s Government


第一条?为规范市人民政府规章立法后评估工作,促进政府规章有效实施,提高政府立法质量和效率,推进依法行政,根据《中华人民共和国立法法》、《规章制定程序条例》等法律、法规规定,结合本市实际,制定本办法。

Article?1?For the purpose of standardizing the post-legislative evaluation of regulations promulgated by the Municipal People’s Government, promoting the effective implementation of governmental rules, enhancing the quality and efficiency of government legislation, and advancing law-based governance, these Measures are formulated in accordance with the Legislation Law of the People’s Republic of China, the Regulations on the Procedures for Formulating Rules, and other relevant laws and administrative regulations, and in light of the actual circumstances of this Municipality.

第二条?市人民政府规章(以下称规章)的立法后评估,适用本办法。

本办法所称立法后评估,是指规章实施后,结合经济社会发展情况,按照一定的标准和程序,对规章的制度措施、执行情况和实施效果等进行调查、分析、评价,提出完善政府立法、改进行政执法工作等意见和建议,形成立法后评估报告的活动。

Article 2?The post-legislative evaluation of the regulations promulgated by the Municipal People’s Government (hereinafter referred to as "regulations") shall be governed by these Measures.

For the purposes of these Measures, "post-legislative evaluation" refers to the activity?for, after any governmental rules are implemented,?investigating, analyzing, and evaluating the regulation’s institutional measures, enforcement status and effects, proposing opinions and suggestions for improving government legislation and administrative law enforcement, and culminating in the formation of a post-legislative evaluation report?according to the economic and social development demands and certain standards and procedures.

第三条?立法后评估工作应当遵循客观公正、科学规范、社会参与、注重实效的原则。

Article 3?Post-legislative evaluation work shall adhere to the following principles: objectivity and fairness, scientific rigor and standardization, public participation, and a focus on practical results.

第四条?市人民政府领导立法后评估工作。市司法行政部门具体负责组织、协调和指导立法后评估工作。

Article 4?The Municipal People’s Government shall lead the post-legislative evaluation work. The municipal judicial administrative department is responsible for the specific organization, coordination, and guidance of the post-legislative evaluation work.

第五条?规章的实施单位是立法后评估的责任单位(以下称评估单位);有多个实施单位的,主要实施单位为评估单位;实施单位不明确的,由市司法行政部门按照职责相关的原则,确定评估单位。

对规范政府共同行为以及与经济社会发展或者公众利益密切相关的规章,市司法行政部门根据需要可以组织开展立法后评估工作。

Article 5?The implementing unit of a regulation is responsible for its post-legislative evaluation (hereinafter referred to as the "evaluation entity"). If there are multiple implementing units, the primary implementing unit shall be the evaluation entity. If the implementing unit is not clearly defined, the municipal judicial administrative department shall designate the evaluation entity?based on the principle of relevant responsibilities.

The municipal judicial administrative department may, when necessary, organize and conduct the post-legislative evaluation of?regulations that govern the common conduct of government or are closely related to economic and social development or the public interest.

第六条?规章有下列情形之一的,应当进行立法后评估:

(一)拟上升为地方性法规的;

(二)拟进行重大修改,或者拟废止但有较大争议的;

(三)与经济社会发展或者公众利益密切相关,且实施满5年的;

(四)人大代表、政协委员以及社会公众提出意见和建议较多的;

(五)行政执法监督、行政复议、行政诉讼等工作中发现规章实施存在问题较多的;

(六)市人民政府要求进行评估的。

因紧急情况需要进行规章修改的,可以不进行立法后评估。

Article 6?A regulation shall undergo post-legislative evaluation under any of the following circumstances:
????(1) It is proposed to be elevated to a local legislative regulation;
????(2) It is proposed for significant amendment, or for repeal where there is considerable dispute;
????(3) It is closely related to economic and social development or the public interest and has been in effect for five years;
????(4) A significant number of opinions and suggestions have been raised by deputies to the NPC and members of the CPPCC National Committee, or the public;
????(5) A significant number of problems with the rule’s implementation have been identified through administrative law enforcement supervision, administrative reconsideration, administrative litigation, or other work;
????(6) The Municipal People’s Government requires an evaluation.

Post-legislative evaluation may be exempted if a regulation requires amendment due to emergency.

第七条?立法后评估工作应当按照计划进行。市司法行政部门根据立法后评估范围和实际工作需要,会同有关单位对规章项目进行研究,编制立法后评估计划并组织实施。

立法后评估计划应当包括规章项目名称、评估单位、工作要求等内容。

立法后评估计划在执行中可以根据实际情况予以调整。

Article 7?Post-legislative evaluation work shall be conducted in accordance with a formulated plan. The municipal judicial administrative department shall, based on the scope of post-legislative evaluation and practical needs, collaborate with relevant units to research rule projects, formulate a post-legislative evaluation plan, and organize its implementation.

The post-legislative evaluation plan shall include the name of the rule project, the evaluation entity, and work requirements, among other content.

The post-legislative evaluation plan may be adjusted during its execution based on actual circumstances.

第八条?评估单位应当按照立法后评估计划,对有关规章或者规章中有关规定进行评估,也可以对涉及特定领域、内容的规章进行专项评估。

Article 8?The evaluation entity?shall, in accordance with the post-legislative evaluation plan, evaluate the relevant rules?or specific provisions. It may also conduct special evaluations of rules concerning specific fields or content.

第九条?开展立法后评估工作,评估单位应当对规章中涉及行政许可、行政处罚、行政检查、行政给付等与公众利益密切相关的事项进行重点评估。

Article 9?When conducting post-legislative evaluation work, the evaluation entity?shall focus on evaluating matters within the rule that are closely related to the public interest, such as administrative licensing, administrative penalties, administrative inspections, administrative benefits?and so on.

第十条?开展立法后评估工作,评估单位应当全面调查了解规章的实施情况,运用科学的方法和手段收集、分析相关信息资料,做到定量和定性分析相结合。

评估单位不得预设立法后评估结论,不得片面取舍有关信息资料。

Article 10?When conducting post-legislative evaluation work, the evaluation entity?shall comprehensively investigate and master the implementation of the rule, and shall collect and analyze relevant information and data using scientific methods and tools, combining both quantitative and qualitative analysis.

The evaluation entity?shall refrain from predetermining?the conclusions of the post-legislative evaluation and avoid selectively including or excluding relevant information and data.

第十一条?开展立法后评估工作,评估单位可以采用实地调研、问卷调查、网络调查、座谈论证、专家咨询、案例研究、文献研究、立法比较分析等多种方法进行。

鼓励评估单位根据规章特点和工作需要创新评估方法,运用现代科学技术手段,提高评估工作质量。

Article 11?When conducting post-legislative evaluation work, the evaluation entity may utilize a variety of methods, including on-site investigations, questionnaire surveys, online surveys, symposiums and expert consultations, case studies, literature reviews, comparative legislative analysis?etc.

Evaluation entities?are encouraged to innovate evaluation methods based on the characteristics of the rule and work requirements, and to utilize modern scientific and technological means to enhance the quality of the evaluation work.

第十二条?开展立法后评估工作,评估单位应当通过政府网站、政务新媒体或者政务服务平台等发布被评估规章全文和评估相关信息,明确征集意见的方式和渠道,为社会公众参与立法后评估工作提供便利。

Article 12?When conducting post-legislative evaluation work, the evaluation entity shall publish the full text of the rule under evaluation and related evaluation information on governmental websites, governmental new media platforms, or governmental service platforms?etc., and shall clearly state the methods and channels for soliciting opinions, so as to facilitate public participation in the post-legislative evaluation work.

第十三条?有关部门和单位应当按照各自职责和评估工作需要,提供与规章实施情况有关的信息资料,配合评估单位做好立法后评估工作。

Article 13?Relevant departments and units shall, in accordance with their respective responsibilities and the needs of the evaluation work, provide information and materials related to the implementation of the rule and cooperate with the evaluation entity?to properly carry out the post-legislative evaluation.

第十四条?评估单位根据工作需要,可以将立法后评估或者评估的部分事项委托符合条件的高等院校、科研机构、社会团体、中介机构等单位具体实施。

Article 14?The evaluation entity?may, as needed, entrust the post-legislative evaluation or specific parts thereof to qualified entities such as institutions of higher education, scientific research institutes, social organizations, intermediary agencies and other entities for their concrete implementation.

第十五条?受委托评估单位应当依法设立,具有完成受委托事项所需工作条件和专业人员,熟悉受委托事项所涉及的相关领域事务。

Article 15?The entrusted evaluation entity?shall be legally established, possess the necessary working conditions and professional personnel to complete the entrusted tasks, and be familiar with the affairs of the relevant fields involved in the entrusted matters.

第十六条?评估单位应当加强对受委托评估单位的指导和监督,受委托评估单位应当在委托范围内开展立法后评估工作,不得将受委托事项再次委托其他单位和个人。

Article 16?The evaluation entity?shall strengthen its guidance and supervision over the entrusted evaluation entity. The entrusted evaluation entity?shall conduct the post-legislative evaluation within the scope of the entrustment and shall not re-entrust the entrusted matters to any other unit or individual.

第十七条?立法后评估工作按照下列标准进行:

(一)规章是否符合党中央、国务院的重大决策部署和国家重大改革方向,是否符合上位法的规定和立法权限;

(二)规章是否符合城市战略定位,立法目的和制度措施是否适应经济社会发展和社会治理的现状;

(三)规章规定的行为规范、执法措施和程序,是否明确具体、严谨合理、易于遵照执行,与立法目的是否符合比例原则;

(四)规章设定的制度措施之间是否相互衔接、协调,与同位阶规章之间是否冲突,有关配套制度是否完备;

(五)规章是否得到有效宣传,是否被管理服务对象知晓、遵守,是否能够有效解决有关领域的具体问题,实现预期效果。

市司法行政部门应当根据立法后评估标准,制定科学的立法后评估指标体系。

Article 17?Post-legislative evaluation work shall be conducted according to the following standards:
????(1) Whether the rule conforms to major decisions and deployments of the CPC Central Committee and the State Council and the direction of major national reforms, and whether it complies with the provisions of higher-level laws and its legislative authority;
????(2) Whether the rule aligns with the city’s strategic positioning, and whether its legislative purpose and institutional measures are adapted to the current state of economic and social development and social governance;
????(3) Whether the behavioral norms, enforcement measures, and procedures stipulated in the rule are clear, specific, rigorous, reasonable, easy to comply with, and consistent with the legislative purpose in accordance with the principle of proportionality;
????(4) Whether the institutional measures established by the rule are interconnected and coordinated, whether there are conflicts with rules of the same level, and whether related supporting systems are complete;
????(5) Whether the rule has been effectively publicized, whether it is known and complied with by its management and service recipients, and whether it can effectively resolve specific issues in relevant fields and achieve its intended effects.

The municipal judicial administrative department shall, based on the post-legislative evaluation standards, formulate a scientific index system for post-legislative evaluation.

第十八条?立法后评估一般按照下列程序进行:

(一)评估单位成立评估小组,成员由评估单位的相关人员组成,评估小组可以邀请相关领域人大代表、政协委员、专家和行业组织代表等参加;

(二)制定评估工作方案,明确评估的目的、内容、方法、步骤以及工作安排等事项;

(三)收集信息资料,听取有关政府部门、基层单位、管理服务对象、专家、社会公众等方面的意见和建议;

(四)对于收集到的信息资料以及意见和建议进行研究分析,提出初步评估结论;

(五)对初步评估结论作进一步研究论证,形成评估报告。

Article 18?Post-legislative evaluation shall generally follow these procedures:
????(1) The evaluation entity?shall form an evaluation team, composed of relevant personnel from the evaluation entity. The evaluation team may invite deputies to the NPC,?members of the CPPCC National Committee, experts, representatives of industry organizations from relevant fields and so on to participate;
????(2) An evaluation work plan shall be formulated, specifying the purpose, content, methods, steps, work arrangements for the evaluation?etc.;
????(3) Information and data shall be collected, and opinions and suggestions shall be solicited from relevant government departments, grassroots units, management and service recipients, experts, the public?and so on;
????(4) The collected information, data, opinions, and suggestions shall be studied and analyzed to form preliminary evaluation conclusions;
????(5) The preliminary evaluation conclusions shall be further studied and deliberated to form the evaluation report.

第十九条?评估单位应当结合实际工作情况,合理使用受委托评估单位的工作成果,不得以受委托评估单位工作成果替代评估报告。

Article 19?The evaluation entity?shall, in light of its actual work, reasonably utilize the work products of the entrusted evaluation entity?and shall not substitute the work products of the entrusted evaluation entity?for its own evaluation report.

第二十条?评估报告主要包括下列内容:

(一)立法后评估的目的和对象;

(二)立法后评估的方法和过程等工作情况;

(三)对规章的制度措施、执行情况和实施效果等方面的分析评价;

(四)规章及其实施存在的主要问题和原因分析;

(五)立法后评估结果及工作建议。

Article 20?The evaluation report shall primarily include the following content:
????(1) The purpose and object of the post-legislative evaluation;
????(2) A description of the work, including the methods,the?process of the post-legislative evaluation?and so on;
????(3) An analysis and evaluation of the rule’s institutional measures, enforcement status, effects?etc.;
????(4) An analysis of the main problems and causes existing in the rule and its implementation;
????(5) The results of the post-legislative evaluation and work recommendations.

第二十一条?评估单位应当按照立法后评估计划的要求,向市司法行政部门报送评估报告。

市司法行政部门对评估单位报送的评估报告组织评审,向评估单位反馈评审意见及工作建议;发现评估报告在立法后评估的内容、程序、方法、结果等方面存在较大问题的,可以要求评估单位补充开展评估工作,完善评估报告。

Article 21?The evaluation entity?shall submit the evaluation report to the municipal judicial administrative department in accordance with the requirements of the post-legislative evaluation plan.

The municipal judicial administrative department shall organize a review of the evaluation report submitted by the evaluation entity?and provide feedback on the review opinions and work recommendations to the evaluation entity. If significant problems are found in the content, procedures, methods, or?results of the post-legislative evaluation?etc., the department may require the evaluation entity?to conduct supplementary evaluation work and improve the evaluation report.

第二十二条?对于专业性较强的规章,市司法行政部门可以邀请熟悉该领域情况的专家、学者等参加评估报告的评审工作。

Article 22?The municipal judicial administrative department may invite experts, scholars, and other qualified professionals with relevant expertise to participate in the review of the evaluation report concerning the evaluation of a regulation involving highly technical content.

第二十三条?评估报告是修改或者废止有关规章及编制立法计划的重要参考。

评估报告建议改进行政执法工作或者完善规章配套制度的,规章的实施单位应当及时研究落实。

Article 23?The evaluation report shall serve as an important reference for amending or repealing the relevant rule and for formulating legislative plans.

If the evaluation report recommends improving administrative law enforcement or refining the rule’s supporting systems, the implementing unit of the rule shall promptly study and implement such recommendations.

第二十四条?参加立法后评估工作的单位和个人,应当严格履行保密义务。

Article 24?Units and individuals participating in post-legislative evaluation work shall strictly fulfill their confidentiality obligations.

第二十五条?立法后评估工作所需经费,由评估单位予以保障。

Article 25?The evaluation entity??shall ensure? funding for post-legislative evaluation work.

第二十六条?市司法行政部门应当建立健全立法后评估工作长效机制,定期向市人民政府报告有关情况,推动本市与北京市、河北省以及其他省区市开展立法后评估工作交流、资源共享和成果互鉴。

Article 26?The municipal judicial administrative department shall establish and improve a long-term mechanism for post-legislative evaluation work, regularly report relevant situations to the Municipal People’s Government, and promote exchanges, resource sharing, and mutual learning from achievements in post-legislative evaluation work with Beijing Municipality, Hebei Province, and other provinces, autonomous regions, and municipalities.

第二十七条?本办法自202571日起施行。

Article 27?These Measures shall enter into force on July 1, 2025.
